A couple who intends to be married in New York State must apply in person for a marriage license to any town or city clerk in the state. A marriage license allows the couple to be married anywhere in New York State.
Note that it usually takes about thirty (30) minutes to process a marriage license application. As City Hall hours are 9:00am to 5:00pm, we cannot accept marriage license applications after 4:30pm. Please plan accordingly.
To obtain a marriage license in the City of Binghamton, the couple must apply in person. Each party must provide the following:
- Application. A completed Marriage License Application.
- Proof of Age. There are three types of documents which are accepted as Proof of Age: (1) original or certified copy of birth certificate; (3) original or certified copy naturalization record; or (4) census record. No substitutions for Proof of Age are allowed.
- Proof of Identity. There are four types of documents which are accepted as Proof of Identity: (1) current driver's license; (2) current passport; (3) current Sheriff's I.D.; or (4) immigration record. No substitutions for Proof of Identity are allowed.
- Records on Previous Marriages. Certified copies of all divorce records or death certificates, if applicable, showing that all previous marriages have ended.
All documents must either be in English, or must be accompanied by a certified translation. In addition, if either party is unable to speak English, a translator must accompany the couple. Note that neither party seeking to obtain a marriage license can act as translator for the other party. The fee for a marriage license is $40, payable by cash, money order or local bank check.
